This application is licensed to you under the Apple Standard End User License Agreement (EULA) available at https://www.apple.com/legal/internet-services/itunes/dev/stdeula/, in addition to the Terms of Service below. By downloading or using the app, you agree to these terms.
1. Acceptance of Terms
By accessing and using RouteWhiz mobile application, you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use our service.
2. Description of Service
RouteWhiz is an AI-powered travel route planning application that:
- Creates optimized travel itineraries using AI algorithms
- Provides AI-powered trip planning, chat assistance, and personalized recommendations
- Offers navigation and mapping features via Google Maps
- Provides weather information for trip destinations
- Enables collaborative trip planning with other users
- Includes premium features available through subscription
3. User Accounts
3.1 Registration
- You must provide accurate and complete information
- You may register using email, Apple Sign-In, or Google Sign-In
- You are responsible for maintaining account security
- You must be at least 13 years old to use RouteWhiz
3.2 Account Security
- Keep your login credentials confidential
- Notify us immediately of any unauthorized access
- You are responsible for all activities under your account
4. User Content and Conduct
4.1 Your Content
- You retain ownership of routes, trips, and notes you create
- By making routes public, you grant us license to display them to other users
- Content shared through collaboration features is visible to invited collaborators
- You can delete your routes and content at any time
4.2 Prohibited Conduct
You agree NOT to:
- Violate any laws or regulations
- Infringe on others' intellectual property rights
- Upload harmful, offensive, or inappropriate content
- Attempt to hack, reverse engineer, or abuse our systems
- Use automated bots or scrapers
- Share false or misleading route information
- Abuse AI features by submitting harmful, illegal, or manipulative prompts
- Attempt to circumvent free tier usage limits or subscription restrictions
5. AI-Powered Features
5.1 AI Services
RouteWhiz uses artificial intelligence (powered by third-party AI providers, including OpenAI) to provide features such as:
- AI Planner: Automated trip itinerary generation through conversation
- AI Chat: Real-time travel planning assistant
- AI Quick Fill: Automatic activity suggestions for trip days
- AI Thematic Plans: Alternative itineraries based on travel themes
- AI Route Guide: Local tips and recommendations for active routes
- AI Trip Check: Travel warnings and local event information
- AI Route Insights: Budget, transport, food, and safety recommendations
5.2 AI Data Usage and Consent
- AI features require your explicit consent before use, in accordance with Apple App Store Guidelines (Section 5.1.1)
- When you use AI features, relevant trip data (such as trip name, city, dates, interests, and preferences) is sent to our AI providers for processing
- Your data is used solely to generate trip suggestions and is not stored or used for AI model training by our providers
- You can revoke AI consent at any time through the app's Settings
- AI chat conversation history is stored locally on your device with a 30-day retention period
5.3 AI Limitations
- AI-generated content is provided as suggestions only and may contain inaccuracies
- Always verify AI recommendations, especially for travel safety, opening hours, and pricing
- We are not liable for decisions made based on AI-generated content
- AI feature availability and quality depend on third-party AI service providers
6. Premium Subscription
6.1 Free Tier
Free users receive:
- Up to 2 trip creations per month
- 5 AI chat messages per day
- AI Quick Fill for a single day per trip
- Basic route planning and discovery features
- 1 collaborator per trip
6.2 Premium (Pro) Features
Premium subscription includes:
- Unlimited trip creation
- 100 AI chat messages per day
- Full access to AI Planner, AI Thematic Plans, AI Route Guide, and AI Trip Check
- AI Quick Fill for all days
- Offline route downloads
- Expense tracking
- Trip file attachments
- Route duplication
- Unlimited collaborators per trip
- Full AI Route Insights and Hidden Gems access
- Digital Passport and Scratch Map sharing
6.3 Pricing and Billing
- Subscription plans: Weekly ($4.99/week), Monthly ($9.99/month), and Yearly
- Subscription fees are charged via Apple App Store
- Pricing displayed in the app before purchase
- Auto-renewal unless cancelled before the renewal date
- No refunds for partial subscription periods (per Apple policy)
6.4 Cancellation
- Cancel anytime through Apple App Store settings
- Access continues until end of current billing period
- No penalty for cancellation
7. Collaboration Features
- You may invite other RouteWhiz users to collaborate on trip planning
- Collaborators can view and edit shared trip content
- You are responsible for content shared within collaborative trips
- Free users may invite 1 collaborator per trip; Pro users have unlimited collaborators
8. Third-Party Services
8.1 Google Maps Platform
8.2 OpenAI
- AI features are powered by OpenAI's language models
- Subject to OpenAI Terms of Use
- Trip data shared with OpenAI is governed by our data processing agreement with them
8.3 Weather Data
- Weather information provided by Open-Meteo API
- Weather data accuracy is not guaranteed
8.4 Images
- Destination and place images provided by Unsplash
- Subject to Unsplash Terms
8.5 Payments
- In-app purchases managed through RevenueCat and Apple App Store
- Payment processing is handled entirely by Apple; we do not store payment information
8.6 Analytics
9. Disclaimers and Limitations
9.1 Service Availability
- We strive for high uptime but do not guarantee uninterrupted service
- Maintenance periods may cause temporary unavailability
- Third-party API failures (Google Maps, OpenAI, etc.) may affect functionality
9.2 Route and AI Accuracy
- Routes and AI suggestions are algorithmic recommendations, not guaranteed itineraries
- Opening hours, place information, and pricing may be outdated or inaccurate
- AI-generated travel advice should be independently verified
- Always verify critical information, especially for travel safety
- Use navigation features responsibly and safely
9.3 Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW:
- We are not liable for indirect, incidental, or consequential damages
- Our total liability is limited to fees paid in the last 12 months
- We are not responsible for third-party service failures
- We are not liable for actions taken based on AI-generated recommendations
10. Privacy
Your privacy is important to us. Please review our Privacy Policy to understand how we collect, use, and protect your data, including data processed by AI features.
11. Changes to Terms
- We may update these Terms of Service
- Continued use after changes constitutes acceptance
- Major changes will be announced in-app
12. Termination
12.1 By You
- You may delete your account at any time
- Account deletion is permanent and irreversible
- Upon deletion, your personal data will be removed in accordance with our Privacy Policy
12.2 By Us
We may suspend or terminate your account if you:
- Violate these Terms of Service
- Engage in fraudulent or abusive behavior
- Abuse AI features or attempt to circumvent usage limits
- Do not pay subscription fees (if applicable)
